Terms of Service

1. Authorization.

The named client is engaging Webmaster4Hire.com, as an independent contractor for the specific web design project of developing and/or improving a web site, hereinafter referred to as "web design project" to be installed on the client's account on an Internet Service Provider (ISP) / Web Presence Provider (WPP) computer, hereinafter refer to as "Hosting Service". The client hereby authorizes Webmaster4Hire.com to access this account, and authorizes the Hosting Service to provide Webmaster4Hire.com with "full access" to the client's account, and any other programs needed for this web design project that are included as part of the client's service agreement/level.

2. Development.

Designing a web site to fully work in multiple browsers (and browser versions) can require considerable, extra effort. It could also involve creating multiple versions of code/pages. Webmaster4Hire.com guarantee that the web site we design for you will work in:

Microsoft Internet Explorer versions 5 and up 

Netscape Navigator/Communicator version 4 and up 

While Webmaster4Hire.com will make every effort, always, to design a fully functional web site, our guarantee does not cover AOL, text-based browsers, or any requested special effect that we have advised you against.


3. Assignment of web design project.

Webmaster4Hire.com reserves the right to assign subcontractors to this web design project to insure that the terms of this agreement are met as well as on-time completion.

4. Copyright and Trademarks.

The client retains the copyright to data, files and graphic logos provided by the client, and grants Webmaster4Hire.com the rights to publish and use such material. The client must obtain permission and rights to use any information or files that are copyrighted by a third party. The client is further responsible for granting Webmaster4Hire.com permission and rights for use of the same and agrees to indemnify and hold harmless Webmaster4Hire.com from any and all claims resulting from the client's negligence or inability to obtain proper copyright permissions. A contract for Web site design and/or placement shall be regarded as a guarantee by the client to Webmaster4Hire.com that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested. 

5. Web Site Maintenance.

This agreement allows for minor web site maintenance to pages over a 1-month period, up to an average of one half hour per regular web site, including updating lines and making minor changes to a sentence or paragraph. It does not include updating replacing nearly all the text from a page with new text, major page reconstruction, new pages, guest books, discussion webs, navigation structure changes, attempted updates by client repairs or web design projects delivered to the client via diskette.

The period of 1 months begins on the date the clients web design site has been published to client's hosting service or 30 days from the date this agreement was signed, which ever comes first.

6. Completion Date.

Webmaster4Hire.com and the client must work together to complete the web design project in a timely manner. We agree to work expeditiously to complete the web design project no later than 30 days after the client has submitted all necessary materials. If the client does not supply Webmaster4Hire.com with complete text and graphic content for this web design project within 60 days of the date of order being placed, the project will be considered as completed. If the client wishes to continue, an additional continuation fee of 15% of the total agreement price will be assessed for each month until the web design project is published or the client cancels the web design project in writing.

7. Project Delivery.

Webmaster4Hire.com will install and publicly post or supply the client's Web site by the date specified in the project proposal, or if no such date is specified, within four weeks of the date initial payment is received from the client, unless a delay is specifically requested by the client. 

The web site design project will be published to the client's hosting service. The client understands that Webmaster4Hire.com does not provide any hosting services in connection with this web design project. Hosting services require a separate contract with 2ClickHere.com. The client agrees to select a hosting service which allows Webmaster4Hire.com full access to the client's account via FTP. The client will be solely responsible for all hosting service charges.

Webmaster4Hire.com will provide the client with an opportunity to review the appearance and content of the Web site during the design and once they are completed. At the completion of the project, such materials will be deemed to be accepted and approved unless the client notifies Webmaster4Hire.com otherwise within thirty (30) days of the date the materials are made available to the client.

8. Electronic Commerce Laws.

The client agrees that the client is solely responsible for complying with such laws, taxes and tariffs, and will hold harmless, protect, and defend Webmaster4Hire.com and its subcontractors from any claim, suit, penalty, tax or tariff arising from the client's exercise of Internet electronic commerce.

9. Web Design Project Copyright.

Once you have made the payment for your web project, the final website is your sole property. Any other images/designs created during the design process may not be used by you and remain our property.

10. Standard Media Delivery.

Unless otherwise specified in the project quotation, this Agreement assumes that any text will be provided by the client in electronic format (ASCII text files delivered via e-mail or FTP) and that all photographs and other graphics will be provided electronically in .gif, .jpeg, .png or .tiff format.

11. Design Credit.

A link to Webmaster4Hire.com will appear in either small type or by a small graphic at the bottom of the primary "home" page of the client's Web site. If a graphic is used, it will be designed to fit in with the overall site design. 

12. Access Requirements.

If the client's Web site is to be installed on a third-party server, Webmaster4Hire.com must be granted temporary read/write access to the client's storage directories, and those directories must be accessible via FTP. Depending on the specific nature of the project, other resources might also need to be configured on the server. 

13. Post-Placement Alterations.

Webmaster4Hire.com cannot accept responsibility for any alterations caused by a third party occurring to the client's pages once installed. Such alterations include, but are not limited to additions, modifications or deletions. 

14. Errors and Liability 

Webmaster4Hire.com will make sure all web pages are working properly and without errors before we post them on the WWW. If the client find an error, Webmaster4Hire.com will work with the client to promptly correct that error. However, Webmaster4Hire.com do not accept any liability for errors that are beyond our control. These errors include but are not limited to:

i) Spelling or grammatical errors due to such errors in the original document provided by the client. 

ii) Loss of data provided by the client. It is the client's responsibility to retain a copy of such data for their own records and in case I need a duplicate copy. 

iii) Malfunctioning of web sites on older web browsers or computers. 
Additions, deletions, modifications, or other fraudulent actions by hackers or other people. 

15. General. These Terms and Conditions supersede all previous representations, understandings or agreements.
